1. Web sites and applications covered
This Privacy Policy covers the information practices with respect to the OrgChart Now Service and any associated web sites. Our applications and web sites may contain links to other web sites. The information practices or the content of such other web sites is governed by the privacy statements or policy of such other web sites. The OrgChart Now team encourages you to review the privacy statements/policy of other web sites to understand their information practices.

2. Information collected
When expressing an interest in obtaining additional information about the Services or registering to use the Services, we may require you to provide our company with personal contact information, such as name, your company name, address, phone number, and email address (“Required Contact Information”). When purchasing the Services, we may require you to provide our company with financial qualification and billing information, such as billing name and address, credit card number, and the number of employees within the organization that will be using the services (“Billing Information”). we may also ask you to provide additional information, such as your company number of employees or industry (“Optional Information”).

As you navigate our company’s web sites and applications, we may also collect information through the use of commonly-used information-gathering tools, such as cookies and web beacons (“Web Site Navigational Information”). Web Site Navigational Information includes standard information from your web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on our company’s web sites (such as the web pages viewed and the links clicked).

Our company uses data about our customers to perform the services requested. For example, if you fill out a “Contact Me” web form, our company will use the information provided to contact you about your interest in the Services.

We may provide bulletin boards, blogs, or chat rooms on our company’s web sites. We are not responsible for the personal information you choose to submit in these forums.

Customers and visitors may elect to use our company’s referral program to inform friends about our company’s web sites. When using the referral program, our company requests the friend’s name and email address. We may send the friend a one-time email inviting him or her to visit our company’s web sites.

We may post a list of customers and testimonials on our company’s web sites that contain information such as customer names and titles. We will obtain the consent of each customer prior to posting any information on such a list or posting testimonials.

6. Sharing of information collected

Service Providers
We may share data about customers with our company’s contracted service providers so that these service providers can provide services on our behalf. We may also share data about customers with our company’s service providers to ensure the quality of information provided. Unless described in this Privacy Policy, We do not share, sell, rent, or trade any information with third parties for their promotional purposes.

We may use a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use billing information except for the sole purpose of credit card processing on our company’s behalf.

Compelled Disclosure
We reserve the right to use or disclose information provided if required by law or if our company reasonably believes that use or disclosure is necessary to protect our company’s rights and/or to comply with a judicial proceeding, court order, or legal process.

7. International transfer of information collected
All data is currently stored on our servers is subject to any applicable laws within the country where the server is hosted. Data is not transferred between locations to limit cross border transfer of data. Application security can be used to limit access to data. Customer is responsible for configuring application security to limit cross border access to data.

Servers are currently available in the United States, the United Kingdom, Australia, Canada, Germany and South Africa. Additional servers may be added upon request.

8. Communications preferences
You may send a request to opt out of receiving any marketing and/or sales communications to moc.erawtfoskroweciffo|wontrahcgro#moc.erawtfoskroweciffo|wontrahcgro. Customers cannot opt out of receiving transactional emails related to your OrgChart Now account.

9. Correcting and updating your information
To update billing or other customer Information or to have information deleted, please email moc.erawtfoskroweciffo|wontrahcgro#moc.erawtfoskroweciffo|wontrahcgro. To discontinue your account and to have information you maintained in the Services returned to you, please email moc.erawtfoskroweciffo|wontrahcgro#moc.erawtfoskroweciffo|wontrahcgro. Requests to access, change, or delete your information will be handled within 30 days.

10. Customer Data
Customers may electronically submit data or information (via API query or push mechanism) to the services for hosting and processing purposes (“Customer Data”). We will not review, share, distribute, or reference any such customer data except as required by law. All customer data is classified as confidential. As such, we only access customer data only for the purpose of providing the Services, preventing or addressing service or technical problems, at a customer’s request in connection with customer support matters, or as may be required by law.

The principal of data minimization is used for data collected and processed (e.g. data should not be held or further used unless essential for function of the system).

11. Security
We use robust security measures to protect customer data from unauthorized access, maintain data accuracy, and help ensure the appropriate use of customer data. We host our web sites and applications in a secure server environment that uses firewalls, intrusion detection systems, and other advanced technology to prevent interference or access from outside intruders. Customers are responsible for maintaining the security and confidentiality of their usernames and passwords. All passwords are encrypted using one way encryption mechanisms and are encrypted both while in transit and at rest.

12. Data Storage
We uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run our services. Although we own the code, databases, and all rights to our applications, you retain all rights to your data.

Upon subscription expiry, we will retain the customer data for a period of ninety (90) days. At that time, we will purge customer’s data from all systems. The customer can submit a written request that all data be purged immediately. We will purge data within ten (10) business days of a written request.

13. Changes to this Privacy Policy
We reserve the right to change this Privacy Policy. We will provide notification of the material changes to this Privacy Policy through our company’s web sites at least thirty (30) business days prior to the change taking effect.

14. Your California Privacy Rights
If you are a California resident, California Civil Code Section 1798.83 permits you to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. OfficeWork Software LLC comply with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Frameworks as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of human resources information transferred from the European Union and Switzerland, as applicable to the United States. OfficeWork Software LLC has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. OfficeWork Software LLC commit to cooperate with the panel established by the EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner and comply with the advice given by panel and Commissioner with regard to human resources data transferred from EU and Switzerland in the context of the employment relationship.

In the United States, the Federal Trade Commission has jurisdiction over OfficeWork Software LLC’s compliance with the Privacy Shield.

Personal data stored within our systems is ONLY for use by the account subscribers. OfficeWork Software LLC will not use and/or disclose personal data other than as directed by account subscriber. Any individual wishing to limit the use of their data should work directly with account subscriber to limit data loaded in our systems (as the account subscriber is responsible for and owns all data loaded into our systems). OfficeWork Software LLC certify that they adhere to the Privacy Shield and Swiss Privacy Shield Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement for personal data submitted in participating European countries. OfficeWork Software LLC will not transfer data to third parties without express consent of account subscriber. In giving consent, account subscriber assumes liability for onward transfer to third party.

In the context of an onward transfer OfficeWork Software LLC has responsibility for the processing of personal information it receives under the Privacy Shield and subsequently transfers to a third party acting as an agent on its behalf. The OfficeWork Software LLC shall remain liable under the Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless the organization proves that it is not responsible for the event giving rise to the damage.

In compliance with the Privacy Shield Principles, OfficeWork Software LLC commits to resolve complaints about our collection or use of your personal information. Under certain conditions an individual may invoke binding arbitration to resolve a privacy related issue.

16. GDPR
The General Data Protection Regulation (GDPR) is a set of laws enacted in the EU in 2018. Privacy Shield is an agreement between the EU and US allowing for the transfer of personal data from the EU to US. The GDPR has specific requirements regarding the transfer of data out of the EU. One of these requirements is that the transfer must only happen to countries deemed as having adequate data protection laws. Privacy Shield is designed to create a program whereby participating companies are deemed as having adequate protection, and therefore facilitate the transfer of information. In short, Privacy Shield allows US companies, or EU companies working with US companies, to meet this requirement of the GDPR.
